Start Your Legal Planning at Dying Matters Week

Legal planning is one of those tasks that’s easy to put off, right up until it’s urgently needed. This Dying Matters Week, a series of free talks around the country are breaking down the legal essentials everyone should have in place, well before a crisis makes it complicated.

Wills. A will sets out how your estate is distributed, who’s appointed as executor, and gives your whānau clarity at an already difficult time. Homemade wills can carry real risks if they don’t meet New Zealand’s legal requirements, and without a valid will in place, the law decides how your estate is divided, not you.

Enduring Power of Attorney (EPOA). An EPOA lets you appoint someone you trust to make decisions on your behalf, for property or personal care, if you’re ever unable to make them yourself. Setting one up while you’re well means the person you choose, not the court, makes the call.

Protection of Personal and Property Rights (PPPR). If someone loses capacity without an EPOA in place, the Family Court can be asked to appoint a welfare guardian or property manager under the PPPR Act, a process that’s often more costly, slower, and stressful than planning ahead.

Retirement village contracts. These agreements can be complex, with terms covering weekly fees, deferred management fees, and what happens to your unit when you leave. Understanding the fine print before signing can save considerable stress and cost down the track.

Getting these essentials in order isn’t just a legal exercise, it’s a way of protecting the people you love from added stress at a time they’ll already be grieving. It also plays an important part in bringing death and dying out of the shadows and into the spotlight, treating legal planning as a normal part of life rather than something to avoid.
