Planning Tool Terms of Use

Your use of the Go With Grace Planning Tool, and its content, constitutes your agreement to be bound by these Terms of Use.

User Account

You will be given an account (“User Account“) to access the Go With Grace Planning Tool. Registration of the User Account will require you to provide a valid e-mail address for the communication between Go With Grace and you related to the Online Planning Tool and will require you to create a password for login purposes.

By using the User Account, you will be responsible for maintaining the security of your User Account, for all activities that occur under the User Account and any other actions in relation to the User Account. You should not share your login details with any other person.

Your Responsibilities

You are solely responsible for your use of, and actions on, the Go With Grace Planning Tool and use it at your own risk.

The Go With Grace Planning Tool is available to persons aged 18 and over. If you are under the age of 18, Go With Grace does not accept any responsibility for you breaching our terms of use by creating a plan.

If you have been asked to create a plan on behalf of another person, we accept no responsibility for the accuracy of this content. You are responsible for ensuring the information provided is an accurate representation of the person’s wishes and beliefs.

By using the Go With Grace Planning Tool, you are agreeing to:

  • comply with applicable laws
  • respect the rights of others, including privacy and intellectual property rights
  • don’t abuse or harm others or yourself (or threaten or encourage such abuse or harm) – for example, by misleading, defrauding, or misrepresenting others
  • don’t abuse, harm, interfere with, or disrupt the services provided by Go With Grace, including our Planning Tool – for example, by accessing or using them in fraudulent or deceptive ways, introducing malware, or spamming, hacking, or bypassing our systems or protective measures.

Legal Status

A Go With Grace Plan is not a legally binding document. However it should be viewed as supporting documentation for your will and other legal documents, and you are encouraged to share with your lawyer.

User Access

There is no public facing version of a Go With Grace Plan. This content is held securely within the site and cannot be accessed by any public link. In order to see your Plan, you will need to log in to your account.

You have the right to share your Go With Grace Plan with others via email invitation. Nominated people you choose to share your plan with will receive an email telling them that you have shared your Go With Grace Plan with them. In order to see your Go With Grace Plan, these nominated people will receive an email, and be asked to click on a link and create a free account using their name and email address in order to see your Plan. Your Go With Grace Plan is shared with nominated people via a secure read-only link, which means no-one else is able to edit or change it.

Availability

Go With Grace will make reasonable efforts to ensure that the Planning Tool is available to you. However, access to the Planning Tool may be disrupted from time to time due to necessary maintenance, technical issues or events outside of Go With Grace’s control. Go With Grace will use reasonable efforts to avoid downtime of the Planning Tool, but assumes no liability if the Planning Tool or any part of the website thereof is unavailable at any time or for any period.

User Generated Content

In order to create a Go With Grace Plan, you are required to record and store information, as well as having the option to upload, send, and share your information. There is no obligation for you to create a Go With Grace Plan – it is completely your choice to create a Plan and choose the information you wish to include in your Plan. If you choose to upload documents or other content, and share content with others, please ensure you have the right to do so and that the content you are sharing is lawful.

Go With Grace has not reviewed the User Generated Content posted in an individual Go With Grace Plan and is not responsible for the User Generated Content. Furthermore, Go With Grace makes no representations, warranties or guaranties, whether express or implied, that the User Generated Content is accurate, complete or up-to-date.

Deleting a Go With Grace Plan

You can choose to delete your Go With Grace Plan at any time. We recommend you download and save your Go With Grace Plan before deleting your account. When you delete your account, all information relating to your plan will be permanently removed from our website and no longer accessible.

If a plan has been shared with you and the person who created the plan has died, you can get it in touch with us to request that the plan is removed. Email us at hello@gowithgrace.nz with the person’s name, date of birth and a copy of the death certificate.

If a plan remains inactive for 10 years and attempts to contact the account holder are unsuccessful, we reserve the right to remove the plan.
